In China, the concept of the rule of law has long been distorted, reduced to a tool for maintaining the regime’s stability rather than a safeguard for justice and fairness for the people. Under the guise of "whole-process democracy," Xi Jinping attempts to disguise a dictatorship as a manifestation of the people's will. In reality, it is nothing more than a blatant violation of the true spirit of the rule of law.
China's "National People's Congress" is supposed to be a legislative body representing the people. However, under Xi Jinping’s rule, it has become nothing more than a rubber stamp, completely subservient to the CCP’s directives. The Party stands above the law, Xi Jinping stands above the Party, and only the Party’s will prevails. The judiciary has completely lost its independence, where judicial rulings are dictated by the leader’s intentions.
The police, who should be upholding social order and protecting citizens' rights, have now become mere enforcers of authoritarian rule, wantonly suppressing and persecuting innocent people. Anyone who dares to speak out faces warnings, surveillance, arrest, enforced disappearance, or even torture. Fundamental freedoms—freedom of speech, freedom of belief, and freedom of association—cornerstones of a true rule-of-law society, have been utterly destroyed under Xi Jinping’s rule.
I have been arbitrarily arrested and persecuted simply for questioning the illegal actions of the police in Shangqiu City, Henan Province. Not only have I suffered personally, but my family has also been implicated, and even the safety of my underage child has been threatened. I have followed legal procedures, reporting the case step by step from the local level to the highest authorities, yet no one has responded. This is the harsh reality of the so-called rule of law under Xi Jinping. I am both a witness and a victim of this cruel reality.
Under Xi Jinping’s rule, the so-called "governing the country according to law" is nothing but a facade for tyranny. True rule of law means that laws must stand above all power and that everyone, including national leaders, must be bound by the law. However, in today’s China, Xi Jinping not only controls the legislative, executive, and judicial branches but has also abolished term limits through constitutional amendments, placing his personal authority above the nation’s institutions. The law has become a mere instrument for consolidating his dictatorship, while the judiciary has become a sword to suppress dissent.
The key to a country’s rule of law lies in the independence and fairness of its legal system. However, under Xi Jinping’s rule, the judiciary has completely lost its independence. Court rulings are nothing more than extensions of the Party's will, and the public security, prosecution, and judicial systems have all been reduced to instruments of repression. There is no oversight, no checks and balances, and the so-called laws are nothing but empty words.
Xi Jinping is the greatest obstacle to the rule of law in China because he has turned laws into the servant of power, transformed the judiciary into a tool for oppression, and reduced the people to mere obedient subjects. A truly law-based society would never tolerate such authoritarian rule, nor would it allow laws to be manipulated as a dictator’s plaything.
If China is to achieve genuine rule of law in the future, the first step must be to remove Xi Jinping, the greatest obstacle, so that laws can once again serve justice and the people, rather than serving a dictator.
